Subsequent to the order being pronounced on 22.08.2025, Mr.N.Manokaran, learned counsel for the respondents 1 and 2 brought my notice that both respondents 1 and 2 have not been served and this 1/3 https://www.mhc.tn.gov.in/judis C.R.P. (PD) No.2757 of 2024 Court had proceeded to go by the acknowledgment cards that have been received, in response to the private notice sent by the learned counsel for the petitioners. Though the learned counsel for the petitioners has addressed the private notice to the counsel for the respondents 1 and 2 before the trial Court, however, the said notice has been received by the Sheristadar of the Sub Court and not by the counsel concerned and therefore, it is a clear case where the respondents 1 and 2 have not been put on notice about the C.R.P. proceedings. 2. In the light of the above, I am inclined to recall the order, dated 22.08.2025 and accordingly, the order, dated 22.08.2025 is recalled. 3. Mr.N.Manokaran, learned counsel would further state that he has filed vakalat for respondents 1 and 2, today. 4. Registry is directed to print the name of Mr.N.
