JUDGMENT 26/09/2025 AVNEESH JHINGAN, J:- With the consent of learned counsel for the parties, the appeals are taken up for final disposal.
2. These intra court appeals are decided by a common
order as the facts and issues involved are similar. For the sake of convenience, the facts are being taken from D.B. Special Appeal Writ No.960/2025.
3. The intra court appeal is filed against the order dated 03.07.2025 passed by the learned Single Judge in S.B. Civil Writ Petition No.16144/2024 and other connected matters.
4. The brief facts are that the appellants applied for the post of Informatics Assistant in pursuance to advertisement dated 16.01.2023 as amended on 27.06.2024, notified by the Rajasthan Subordinate and Ministerial Service Selection Board (hereinafter referred to as ‘the Board’). The written examination was conducted by the Board on 21.01.2024. The paper of 100 marks comprised of 150 objective type questions. The preliminary answer key was published by the Board on 02.02.2024 and objections were invited from the candidates. The objections were received with regard to eighty nine questions. Preliminary answer key was affirmed for eighty questions, seven questions were deleted and answers of two questions including that of Question No.125 were changed. The final answer key was published on 01.07.2024 and final result was declared. The appellants filed writ
[2025:RJ-JP:39946-DB] (28 of 37) [SAW-960/2025] petition raising the grievance to change in answer of Question No.125 and unchanged answer of Question Nos.12, 50, 89 & 127.
5. Learned Single Judge after hearing the parties, perusing the pleadings and report of the subject experts dismissed the writ petition. It was held:- (i) that the scope of interference in judicial review in dispute of correctness of answer of the question in public examination is limited; (ii) no clear cut case was made to show that answers to the five questions were apparently wrong; (iii) that the court can neither substitute its opinion nor can act as an expert; and (iv) lastly that the material considered by the subject experts to consider the objections was not stated to be unreliable or unauthenticated. Hence, the present appeal.
6.
Learned counsel for the appellants have pressed the challenge only to the change of answer to the question No.125. The contention is that in the books referred to in appeal the answer to the question no.125 is Dynamic RAM and not Static RAM. It is argued that in Dynamic RAM the transistor and capacitor are separately fitted whereas in Static RAM the capacitor is inbuilt in MOS transistor and the question ought to have clarified by use of term MOSFET. It is submitted that objection was not rightly considered by the expert committee.
7. As per contra, the examination was held in a fair and transparent manner, no malafide or irregularity is alleged in holding the examination. The argument is that a fair opportunity was granted to the candidates to file objections to the preliminary answer key. The committee of subject experts considered the
[2025:RJ-JP:39946-DB] (29 of 37) [SAW-960/2025] objections and on its recommendation the answer of question No.125 was changed. The report of the committee and the material relied upon to change the answer of the question is pressed into service. The submission is that scope of interference or the correctness of the answer to the question in a public examination in writ jurisdiction is limited.
8. The only issue pressed in this appeal is with regard to the change of answer to question No.125.
9. Before proceeding further, it would be appropriate to reproduce Question No.125:-
“125. I am a Memory device. I am composed of transistors and capacitors. I am able to access the data fast. Who am I? (A) Dynamic ROM (B) Static RAM (C) Dynamic RAM (D) Static ROM (E) Question not attempted.”
10. In the preliminary answer sheet answer to Question No. 125 was specified as Option (C) ‘Dynamic RAM’. On considering the objections, the answer was changed to Option (B) ‘Static RAM’.
11.
Learned counsel for the appellants, during pendency of the appeal while arguing the matter, sought time to further study the expert committee report and to have instructions from the clients. Learned counsel for the appellants on instructions from clients submit that it is not disputed that both Dynamic RAM and Static RAM have transistors and capacitors but the difference is that in Static RAM the transistors used have inbuilt capacitors
[2025:RJ-JP:39946-DB] (30 of 37) [SAW-960/2025] whereas Dynamic RAM is composed of a separate transistor and capacitor therefore the correct answer was only Dynamic Ram. 12. The material relied upon by the expert committee is reproduced below:-
“Justifying for the validity of the Statement "SRAM is composed of Transistors and Capacitors" The justification is grounded in the principle of transitive relationships in logical reasoning and in the technical understanding of the structure and components of SRAM. The logical flow and technical explanation of the components that make up SRAM will be outlined to demonstrate the validity of the statement. Statement of Facts:
1. SRAM Composition: Static Random Access Memory (SRAM) consists of memory cells made from MOS Transistors. 2. MOS Transistors in SRAM: An SRAM cell typically uses a configuration of 6 MOS transistors to form a flip-flop circuit that enables data storage. These transistors are responsible for switching the stored state. 3. Role of Capacitors in SRAM: While SRAM cells primarily rely on transistors for their data storage and access functions, capacitors (MOS capacitors) are part of the metal-oxide-semiconductor
field-effect
transistors (MOSFETs, MOS-FETs, MOS FETs, or MOS transistors). Sources:

"Physically, the MOSFET is essentially nothing more than an MOS-capacitor with two pn junctions placed immediately adjacent to the regions of the semiconductor controlled by the MOS-gate. 4. MOS Capacitors and MOS Transistors: The MOS transistors (used in SRAM) contain MOS Capacitors as part them. Specifically, the MOS capacitor is a fundamental part which formed between the gate (metal), oxide (insulating layer), and semiconductor (channel) of the transistor, and plays an essential role in controlling the flow of current. 5. Transitive Property: The principle of transitive relations in logic asserts that if: • A is related to B, and (A is composed of B) • B is related to C, then, (B is composed of C) • A is related to C. (A is composed of C) Source:
MATHEMATICS Textbook for Class XII PART I Chapter 1 Relation and Functions Page 2 https://ncert.nic.in/textbook.php?lemhl=1-6 Definition 3 A relation R in a set A is called (i) reflexive, if (a, a) ER, for every a E A, (ii) symmetric, if (a1, a2) E R implies that (a2, a1) ER, for all a1, a2 E A. (iii) transitive, if (a1, a2) E R and (a2, a3) E R implies that (a1, a3) E R, for all a1, a2, a3 EA. Therefore, following this principle: • SRAM is composed of MOS transistors. • MOS transistors are composed of MOS capacitors. • SRAM is composed of MOS transistors and MOS capacitors. (Transitivity) • MOS transistor is a Transistor. • MOS capacitor is a Capacitor. • Hence, SRAM is composed of transistors and capacitors. Justification of Validity:-
1. Logical Flow: The statement "SRAM is composed of transistors and capacitors" is logically sound because it follows directly from the composition of MOS transistors (which are composed of MOS capacitors) and the use of
[2025:RJ-JP:39946-DB] (32 of 37) [SAW-960/2025] capacitors in SRAM functionality.
Thus, it is accurate to claim that SRAM is made up of both transistors and capacitors. 2. Scientific and Technical Context: In semiconductor technology, the composition of SRAM cells fundamentally relies on MOS transistors, which themselves contain MOS capacitors. Therefore, capacitors (MOS capacitors) are en essential part of the transistor and contribute to the SRAM composition. 3. Transitivity Applied: • SRAM composed of MOS transistors → • MOS transistors composed of MOS capacitors → • Therefore, SRAM composed of transistors and capacitors. This transitive relationship provides a logical and scientifically valid basis for the statement. Conclusion:- In conclusion, the statement “SRAM is composed of transistors and capacitors” is logically and scientifically valid based on the transitive relationship between the components of SRAM. While MOS transistors are the primary building blocks for SRAM cells, and the MOS capacitors are part of the transistors, the capacitors are undeniably integral to the structure of the transistors that make up the SRAM. As such, SRAM can be correctly described as being composed of both transistors and capacitors, as this is a consequence of the transitive property applied to the structure of the components involved.”
13. The expert committee after considering the relevant material and books concluded that both Dynamic RAM and Static RAM are composed of transistor and capacitor. At this stage, it would be important to note that question No.125 consisted of two parts:- firstly, the composition of component of transistor and capacitors and second part the ability of the component to access the data fast. If the first part of the question is read in isolation the Static RAM and Dynamic RAM both shall qualify as correct answers but the deciding factor was the second part of the question which ousted the option of Dynamic RAM. 14.
The contention raised by the appellant cannot be gone into in writ jurisdiction, as it tantamount to the Court substituting its own opinion for that of the expert committee. The scope of interference in judicial review in a challenge to the correctness of the answer key is well settled and the following decisions of the Supreme Court are referred:- 14.1 In U.P.P.S.C, through its Chairman & Anr. Vs. Rahul Singh & Anr. reported in [2018 INSC 554] the Court held that restraint should be exercised by the courts in entertaining the challenge to the correctness of the answer key. The relevant paras of the judgment is:-
“12. The law is well settled that the onus is on the candidate to not only demonstrate that the key answer is incorrect but also that it is a glaring mistake which is totally apparent and no inferential process or
reasoning is required to show that the key answer is wrong. The Constitutional Courts must exercise great restraint in such matters and should be reluctant to entertain a plea challenging the correctness of the key answers. In Kanpur University case (supra), the Court recommended a system of-(1) moderation; (2) avoiding ambiguity in the questions; (3) prompt decisions be taken to exclude suspected questions and no marks be assigned to such questions. 13. As far as the present case is concerned even before publishing the first list of key answers the Commission had got the key answers moderated by two expert committees. Thereafter, objections were invited and a 26 member committee was constituted to verify the objections and after this exercise the Committee recommended that 5 questions be deleted and in 2 questions, key answers be changed. It can be presumed that these
[2025:RJ-JP:39946-DB] (34 of 37) [SAW-960/2025] committees consisted of experts in various subjects for which the examinees were tested. Judges cannot take on the role of experts in academic matters. Unless, the candidate demonstrates that the key answers are patently wrong on the face of it, the courts cannot enter into the academic field, weigh the pros and cons of the arguments given by both sides and then come to the conclusion as to which of the answer is better or more correct.”
14.2 In Ran Vijay Singh and Ors. Vs. State of Uttar Pradesh & Ors. reported in [(2018)2 SCC 357] it was held that re-evaluation or scrutiny of answer sheet should only be permitted in exceptional or rare case on demonstration of an error committed without the inferential process of reasoning or rationalization. The relevant para of the judgment is quoted:-
“30. The law on the subject is therefore, quite clear and we only propose to highlight a few significant conclusions.
They are: 30.1 If a statute, Rule or Regulation governing an examination permits the re-evaluation of an answer sheet or scrutiny of an answer sheet as a matter of right, then the authority conducting the examination may permit it; 30.2If a statute, Rule or Regulation governing an examination does not permit re-evaluation or scrutiny of an answer sheet (as distinct from prohibiting it) then the Court may permit re-evaluation or scrutiny only if it is demonstrated very clearly, without any
"inferential process of reasoning or by a process of rationalisation" and only in rare or exceptional cases that a material error has been committed, 30.3 The court should not at all re-evaluate or scrutinize the answer sheets of a candidate-it has no expertise in the matter and academic matters are best left to academics; 30.4 The court should presume the correctness of the key answers and proceed on that assumption; and
[2025:RJ-JP:39946-DB] (35 of 37) [SAW-960/2025] 30.5 In the event of a doubt, the benefit should go to the examination authority rather than to the candidate.” 14.3 In Vikesh Kumar Gupta & Another Vs. State of Rajasthan & Ors. reported in [(2021)2 SCC 309] it was held that the courts should be very cautious to interfere with expert opinion in academic matters. The relevant para is:-
“17. A perusal of the above judgments would make it clear that courts should be very slow in interfering with expert opinion in academic matters. In any event, assessment of the questions by the courts itself to arrive at correct answers is not permissible. The delay in finalization of appointments to public posts is mainly caused due to pendency of cases challenging selections pending in courts for a long period of time. The cascading effect of delay in appointments is the continuance of those appointed on temporary basis and their claims for regularization.
The other consequence resulting from delayed appointments to public posts is the serious damage caused to administration due to lack of sufficient personnel.”
15. The material relied upon by the expert committee for considering the objections remained unchallenged. In view of the conclusions reached by the expert committee, the reliance placed by the appellants on certain textbooks shall be of no avail. 16. The appellants have taken us through the material relied upon by the expert committee, but have failed to establish that the conclusion arrived at by the expert committee is on the face of it erroneous that too without any inferential process or
reasoning. Taking the case of the appellants at the highest, the argument is that the earlier answer was also correct but for
[2025:RJ-JP:39946-DB] (36 of 37) [SAW-960/2025] interference in writ jurisdiction the test is that answer is patently wrong on the face of it. The appellant have failed to prima facie show that no reasonable body of expert of subject would accept Static RAM to be the correct answer and that the procedure adopted by the Board of inviting objections to the preliminary answer key was not fair. Reliance is placed on the judgment of the Apex Court in Ran Vijay Singh (supra) wherein after considering the decision in Kanpur University Vs. Samir Gupta reported in [(1983)4 SCC 309] it was held that it must be demonstrated that no reasonable body of men well-versed with the subject would regard the answer to be correct. It was held:-
“The key answer should be assumed to be correct unless it is proved to be wrong and that it should not be held to be wrong by an inferential process of reasoning or by a process of rationalisation. It must be clearly demonstrated to be wrong, that is to say, it must be such as no reasonable body of men well-versed in the particular subject would regard as correct.” In other words, the onus is on the candidate to clearly demonstrate that the key answer is incorrect and that too without any inferential process or reasoning. The burden on the candidate is therefore rather heavy and the constitutional
courts must be extremely cautious in entertaining a plea challenging the correctness of a key answer.”
17. In the case of Ran Vijay Singh (supra) it is held that answer in key should be presumed to be correct and in case of doubt the benefit should go to the examination authority rather than the candidate as held. 18. The contention raised that in case inbuilt capacitor as is used in MOS Transistor was to be considered the term MOSFET
[2025:RJ-JP:39946-DB] (37 of 37) [SAW-960/2025] should have been used in the question, is in fact a grievance that the question could have been phrased accurately. The contention does not fall within the scope of judicial scrutiny in writ jurisdiction of the correctness of the answer key. 19.
The expert committee having examined the answer key and arrived at a reasoned conclusion leaves no scope for interference by this Court in the exercise of its writ jurisdiction. Given the well-settled principles governing judicial review of answer keys in public examinations, the learned Single Judge was justified in declining to interfere with the findings of the expert committee more so, in absence of challenge to the material relied by the expert committee. 20. No case is made out for interference in the intra court appeals, the same are dismissed. 21. All pending misc. applications, if any, stand disposed of.
