The petition coml'ng on for hearI'ng, upon Perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of sri KADIYAM NEELAKANTESWARA RAO, Advocate for the petl'tioner and of PUBLIC PROSECUTOR for the Respondent and the court made the following; #~--,,-,I-, 7 THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 620 of 2025 ORDER: The Criminal Petition, u/Sec.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/accused to grant anticipatory bail in connection with Crime No.01/2025 of Prohibition and Excise Police Station, Rajahmundry North. 2) A case has been registered against the petitioner for the offence punishable u/See.7-B r/w 8-A of the A.P.Prohibition (Amendment) Act. 3) Case of the prosecution in brief is that on 01.01.2025 at about 5.30pm, on receipt of credible information about illegal possession and preparation of liquor, the S.I. of P & E of Rajahmundry North police station, along with staff, rushed to Jam oil garden of forest area in stone crusher between Rayudupakalu to Kolamuru of Rajamahendravaram and found 15 plastic drums with fermented jaggery wash in total 3000 liters of F.J.Wash. On enquiry police came to know that the said F.J.Wash was prepared by the petitioner. Then police drafted special report at the scene of offence. 4) Heard. Perused the record. 5) Basing on the information/confession of others, name of the petitioner has been shown as an accused in the said case. ln pursuance r5ZZ7ZfzZ3E33giv AtHanffl to the confessional statement, nothing has been seized from the possession Of the petl'tioner herein. In view of the same, this court is inclined to consider the prayer of petitioner for grant of anticipatory bail. 6) Accordingly, l'n the event of arrest of petitioner/accused with regard to this crime, he shall be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties for the ll'ke sum to the satisfaction of the arresting police officials and also on condition that the petl-tioner shall make himself available for investl'gation as and when required and that he shall not cause any threat, I'nduCement Or PrOml®Se tO the PrOSeCutI-On Wl'tneSSeS.
