THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY CIVIL REVISION PETITION NO: 3669/2025 ORDER:
1. Heard the learned counsel for the petitioner.
2. This civil revision petition is filed against the order dismissing the petition filed by the petitioner/ defendant under Order VII Rule 11 of CPC to reject the plaint.
3. The learned counsel for the petitioner submits that now the suit itself was dismissed for default on account of non appearance of the plaintiff. Therefore, he seeks permission to withdraw this revision petition as it became infructuous at present with a liberty to file the same in case the suit is restored to file on the application filed by the plaintiff for the said purpose.
4. Permission is accorded.
5. The civil revision petition is dismissed as withdrawn granting liberty as prayed for.
