2. A case has been registered against the Petitioners herein for the offence punishable under Section 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.
Case of the prosecution, in brief, iS that, the de faOfo complainant is the mother, Al is the wife, A2 is the father-in-law and A3 is the brother-in-law of the deceased. Originally, the de faofo complainant lodged a complaint on 27.08.2024 as man missing, wherein she alleged that recently the deceased Came from Kuwait and few days thereafter i.e., On 22.08.2024 the deceased had gone to his wife's house. On 23.08.2024 and 24,08.2024 the deceased had stayed along With- his Wife and that on 24.08.2024 the deceased Was taken tO Ganesh Private Hospital, Kadapa by Al and A2 for treatment. On 26.08.2024, when the daughter of the de facfo complainant asked Al about the whereabouts of the deceased, Al replied that the deceased left their house on 26.08.2024 at about 05.45 AM to come to Vaddipalli village. Thereafter, the deceased could not be seen. They searched for the deceased in the village, relatives' houses and nearby areas, but in vain. while so, on 17.ll.2024, the de facfo complainant came to know that an unidentified male person died after being hit by a train near Pullampeta Railway Station. Then they visited Renigunta Railway Police Station to <=-
3 1 enquire further and the Railway Police informed that an un-Identified male was found dead under the Train on 26.08.2024 around o7.30 AM near Pullampeta Railway Station. In connection with that a case in cr_ime No.94 of 2024 of Renigunta Railway Police Station Was registered for the Offence Punishable under section 194 of the Bharatiya Nyaya Sanhita, 2023. Thereafter, On 25.12.2024, at about 03.00 PM, the de facfo complainant has resorted in filing the present complaint against the petitioners herein allegi]ng that they beat the deceased and insisted to pay all the mOnieS that have been earned by him in Kuwait. lt iS also 'alleged that the accused harassed the deceased and pushed him to go and die.
Accordingly, the \ deceased had taken an extreme step of committing suic'Ide. 4. Heard. PerusedthereCOrd. 5. A perusal of the material On record goes tO Show that there is any amount of ambiguity whether the alleged incident, as suggested by the prosecuti6h, was taken Place Or not. ln the present complaint given by the de faCfo COmPlainant On 25.12.2024, 'lt is alleged that the accused beat the deceased and they 'lnsisted to pay all the mOnieS that have been earned by him -ln Kuwa'lt. lt iS also alleged that the accused harassed the deceased and pushed him to go and die. I 4 1 deceased had taken an extreme step of committl|ng suicide. But, in the earll'est report filed by the de facfo complajnant on 27.08.2024, absolutely there are no such averments. At a belated stage i.e., after lapse of four months, the present complaI'nt has been filed making cerfaI-n accusatI'OnS against the PetjtI'Oners herel'n.
6. Apart from the same, Ion Order to attract the offence under sectI'On 108 of the BNS, it I-S essential that all the jngredI-entS Of / section 45 of the BNS have to be satisfied. There should be an instigation or I'ntentional aI'dl'ng to drl-ve a person to comml't suI|Cide. ln the case on hand, on a plaI-n reading of the materI®al on record, pr7'ma fac,-e, goes to show that the allegation against the petitioners herein is that they harassed and beat the deceased jn order to take money earned by him jn KuwaI't. petitI'Oners were arrested on 27.12.2024 and sI'nCe then they are l'n judjcl'al remand. Learned Assistant public prosecutor submitted that major portion of investigation has been completed. 7, In vI-eW Of the aforesaid facts and cI'rCumstances of the case, thI®S Court Its inclined to grant bail to the petjtjoners/Al to A3 on the following conditl'ons.
