1. By way of this petition, petitioner sought following relief(s) :
“10.1 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of certiorari or direction to quash the impugned order dated 19.06.2025 passed
2 by the learned Chairman, Maintenance Tribunal and Sub-Divisional Officer (Revenue), Bilaspur, which closed the petitioner's right to present arguments 202412072400194/2024-25. in Case No. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the learned Chairman, Maintenance Tribunal and Sub-Divisional Officer (Revenue), Bilaspur to reopen the proceedings, allow the petitioner to present her written/oral arguments, and decide the application on merits after hearing both parties. 10.3 That, any appropriate writ, direction or order may also kindly be passed in favour of the petitioner, which this Hon'ble Court deems fit in the circumstances of the case.”
2. Learned counsel for the petitioner contended that the this petition may be disposed of directing to the Sub Divisional Magistrate, Bilaspur, District Bilaspur (C.G.) to decide the preliminary objection dated 03.04.2025 (Annexure P-3) within time frame.
3. I have heard learned counsel for the petitioner and perused the record with utmost circumspection.
4. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing to the Sub-Divisional Magistrate, Bilaspur, District Bilaspur (C.G.) to decide the preliminary objection dated 03.04.2025 (Annexure P-3) made by the petitioner as expeditiously as possible, in accordance with rules, regulations
3 and law. The said objection made by the petitioner shall decide after giving sufficient opportunity of hearing to the respondents.
5. With the aforesaid direction, this petition stands disposed of. Sd/-
