This Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India by the Petitioners for the following relief:
“..to issue a Writ, Order or direction more particularly one in the nature of a Writ of Writ of Mandamus declaring the declaring the action of the 2nd respondent in not taking action on the communication sent by the 4th respondent vide Rc.A.64/2024 dated 08.04.2024, recommending deleting the land situated in Sy.No.1409-9 (old.Sy.No.1174/A) to an extent of Ac.0.725 cents each belongs to the Petitioners of Nannur village, Oravakal Mandal Kurnool District from prohibitory list under S.22-A(1) of Registration Act, 1908, as illegal, arbitrary. dehors jurisdiction and violative of Articles 14, 21 and 300-A of Constitution of India besides contrary to the provisions of Registration Act, 1908 and to remove the same from the prohibited list of properties, as illegal and arbitrary and for a consequential direction to the 2nd respondent to take action on the communication by the 4th respondent vide Rc.A.64/2024 dated 08.04.2024,recommending deleting the land situated in Sy.No.1409-9 (old.Sy.No. 1174/A) to an extent of Ac.0.725 cents each belongs to the Petitioners of Nannur village, Oravakal Mandal Kurnool District treating it as private patta land and to remove the same from the prohibited list of properties and pass…”
1. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. ::3::

The grievance of the petitioners is that the land admeasuring an extent of Ac.0.725 cents in Sy.No.1409-9 (Old Sy.No.1174/A), situated in Nannur Village, Orvakal Mandal, Kurnool District, was assigned to the 1st petitioner under D-Form patta dated 01.01.1992, and another extent of Ac.0.725 cents in the very same survey number was assigned to the 2nd petitioner under D-Form patta dated 01.01.1992. Since then, the petitioners have been in peaceful possession and enjoyment of the said property, and Pattadar Passbooks and Title Deeds were also issued in their favour. However, to their surprise, the said property came to be included in the list of prohibited properties under Section 22-A(1) of the Registration Act, 1908. Aggrieved thereby, the petitioners submitted representations/applications to the 2nd respondent/District Collector on 08.01.2024 through Spandana. Pursuant to the said representation, the 2nd respondent issued a communication based on the report of the 4th respondent dated 08.04.2024, wherein the 4th respondent recommended deletion of the subject land from the prohibitory list under Section 22-A(1) of the Registration Act, 1908. Despite such recommendation and repeated reminders for deletion of the land from the prohibitory list, the 2nd respondent failed to take any action on the communication and report submitted by the 4th respondent dated 08.04.2024. Such inaction, despite receipt of the communication, is arbitrary and illegal, hence the present writ petition. ::4::
3. In view of the aforesaid circumstances, this Court is not inclined to go into the merits of the case. Accordingly, the Writ Petition is disposed of, granting liberty to the petitioners to submit an online application to the 2nd respondent/District Collector seeking deletion of the subject property from the prohibitory list under Section 22-A(1) of the Registration Act, 1908, within a period of two (02) weeks from the date of receipt of a copy of this order. Upon such application being filed, the 2nd respondent shall consider the same and pass appropriate orders in accordance with law, after obtaining necessary reports from respondent Nos.3 and 4. The entire exercise shall be completed within a period of three (03) months thereafter. There shall be no order as to costs. As a sequel, interlocutory applications if any pending, shall stand closed.
