GP FOR SERVICES II 3 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.32341 of 2025 ORDER: The present writ petition is filed questioning the action of the 2nd respondent in not extending the study leave of the petitioner for the M.Tech Programme in Embedded Systems at Sri Venkateswara Perumal College of Engineering & Technology, Puttur, for the academic year 2024-25, and in not paying salary to the petitioner from March 2025, which is contrary to G.O.Rt.No.28 dated 26.02.2018, as well as in not permitting the petitioner to join duties as Lecturer in ECE at the 4th respondent College, as illegal and arbitrary. 2. The petitioner was initially appointed as Lecturer in Electronics & Communication Engineering in Government Polytechnic, Rayachoti, on 15.10.2013. The petitioner submitted an application seeking sanction of study leave in terms of G.O.Rt.No.28 dated 26.02.2018 for pursuing M.Tech in Embedded Systems. The 1st respondent initially permitted the petitioner to pursue the programme without pay, vide memo dated 10.10.2023. Subsequently, the said permission was modified by proceedings G1/1876/2022 dated 13.10.2023, permitting the petitioner to pursue the M.Tech course for a period of one year on certain conditions and on pay. The petitioner thereafter sought extension of study leave, submitting representations in August 2024, as the M.Tech is a two-year course. While the application for extension was pending, the petitioner completed the M.Tech 4 course and reported for duty at the erstwhile post in the 3rd respondent college. 3. In the annual general transfers conducted in May 2025, the petitioner participated and was transferred to the 4th respondent college. However, the petitioner is not being permitted to attend duty on the ground that the study leave has not been extended, though the petitioner reported before the 4th respondent on 16.06.2025. 4. Smt. Anuradha, learned Assistant Government submits that the study leave of the petitioner is under consideration for the academic year 2024-2025 and the appropriate orders will be passed thereon. 5. Considering the submissions, the writ petition is disposed of with the following directions: i) The respondents shall pass appropriate orders on the petitioner’s request for extension of study leave for the academic year 2024-25 as expeditiously as possible, preferably within a period of eight (08) weeks from the date of receipt of a copy of this order. ii) The salary due to the petitioner shall be paid from the date of entitlement, within a period of eight (08) weeks from the date of receipt of a copy of this order. 5 iii) The respondents shall permit the petitioner to discharge his duties in the 4th respondent college. There shall be no order as to costs.
