Dhaulta, Additional Advocate General. ------------------------------------------------------------------------- Jyotsna Rewal Dua, Judge Petitioner seeks enforcement of Tara Devi versus State of H.P. & Others2, the operative portion of which reads as under:-
“4. Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of by directing the respondents/competent authority to consider and decide the case of the petitioner for redressal of her grievances raised in the writ petition, in accordance with law and taking into consideration the above judgments within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.”
2. Respondents have filed reply. It appears that
consideration order had been passed by the respondents on 20.07.2024. Petitioner’s grievance in this execution 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2CWP No.4569/2024, decoded on 24.05.2024.
2 petition concerns payment of arrears in lump sum instead of in installments in which the arrears due to her are being released by the respondents. In terms of the reply, total arrears due to the petitioner are to the extent of ₹7,18,973/- out of which, an amount of ₹1,43,648/- (first installment) has already been paid to her on 13.08.2024. The second and third installments amounting to ₹2,87,296/- are stated to be in the process of release. Let the installments due to the petitioner as on date be released in her favour within three weeks i.e. by or before 15.08.2026. Petitioner’s prayer for enforcement of Tara Devi2 for release of entire amount in lump sum cannot be countenanced as the only direction in the above decision was to consider and decide the case of the petitioner. In view of consideration order having been passed by the respondents, the cost imposed in terms of the
order dated 25.06.2026 in this petition is waived of. Needless to clarify that petitioner is at liberty to avail appropriate remedy for the redressal of her surviving grievance in accordance with law. Petition stands disposed of accordingly. Pending miscellaneous application(s), if any, shall also stand disposed of. Jyotsna Rewal Dua July 23, 2026
