Neutral Citation No. - 2025:AHC:57215 Court No. - 74 Case :- WRIT - C No. - 11270 of 2025 Petitioner :- Smt. Radhika Sharma And Another Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Abhishe Pandey Counsel for Respondent :- C.S.C. Hon'ble Saurabh Srivastava,J.
1. Heard Sri Abhishek Pandey, learned counsel for petitioners and learned Additional Chief Standing Counsel for the State- respondents. 2. By way of the present writ petition, a direction in the nature of mandamus directing the respondents not to interfere in peaceful marital life of petitioners, has been sought. 3. Learned counsel for petitioners submitted that both the petitioners solemnized marriage between them on 01.04.2025 and the same has also been registered on 02.04.2025 but respondent nos.4 to 6 along with their other family members are still not accepting the said marriage just because they belong to different castes. Learned counsel for petitioners further submitted on 03.04.2025 at about 3-4 A.M., respondent nos.4 to 6 along with their other family members reached at the house of petitioner no.2 and gave threats to lives of petitioners. In pursuance of the said incident, petitioners approached the concerned police station and also intimated to Senior Superintendent of Police, Meerut through registered post but all the actions taken by petitioners, were of no vain. 4. A precise query made before learned counsel for petitioners that whether any application has been preferred before learned court concerned for seeking prayer and direction against concerned police authorities for lodging an FIR, it is fairly submitted that no such application has been preferred by petitioners. 5. Learned Additional Chief Standing Counsel vehemently opposed the prayer sought through the instant petition and rebutted the stand taken up by learned counsel for petitioners by way of submitting that the application with regard to incident dated 03.04.2025, has been sent through registered post on the same date
from Meerut Kutchery, Sub Post Office at about 10.12 A.M. and petitioners were available at District Prayagraj before Oath Commissioner on the same date. By indicating all these things, learned Additional Chief Standing Counsel tries to demonstrate that nothing factual incident has been occurred any point of time. 6.
After having the rival contentions raised by learned counsel for parties, it is crystal clear that marriage of petitioners has already been registered and if any hindrances are being created by respondent nos.4 to 6 in peaceful life of petitioners and the concerned police authorities are not paying any heed, it is always open to the petitioners to approach the concerned court in accordance with law. 7. In view thereof, the present petition stands disposed of with liberty to the petitioners to prefer an appropriate application before learned court concerned for lodging FIR, if required.
