Issue an order or direction in nature of MANDAMUS directing the Trial Court to decide the Election Petition No.129 of 2023 Smt. Zaheer Fatima Vs. Election Commission of Uttar Pradesh & others, pending in the court of Additional District and Session Judge, Room No.1, Saharanpur expeditiously preferably within a period of six weeks with the direction that the Trial Court will not grant any unnecessary adjournment in the matter." It is contended that in the election held for the Chairman, Municipalities, Deoband, Saharanpur, respondent no.6 was declared elected. The election was challenged by the petitioner through Election Petition No.129 of 2023, which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the said election petition. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Court concerned to decide the Election Petition No.129 of 2023, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of six months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
