Order on Board 03/09/2025
1. The challenge in the present writ petition is the order dated 21.08.2025 passed by Respondent No. 3, whereby the petitioner has been assigned of Patwari Halka No. 1, Kolaval.
2.
Learned counsel for the petitioner would submit that the petitioner was transferred vide order dated 10.07.2025 (Annexure P/2) from Tahsil – ALOK SHARMA Digitally signed by ALOK SHARMA Date: 2025.09.03 19:53:58 +0530
2 Bakawand to Tahsil- Karpawand and in pursuance thereof he joined there at Tahsil- Karpawand on 16.07.2025. Thereafter, vide order dated 21.08.2025 (Annexure P/1) he was assigned duties from Patwari Halka No. 8, Karpawand to Patwari Halka No. 1 Kolaval, which is the frequent transfer of the petitioner within a month from his joining. By the frequent transfer the petitioner is facing hardship, therefore, impugned
order may be quashed.
3. On the other hand, learned counsel for the Respondent/State opposes and have submitted that vide order dated 21.08.2025 only the Patwari Halka number has been changed he is still there in Karpawand Tahsil and on administrative exigency he was assigned duties from Patwari Halka No. 8 Karpawand to Patwari Halka No. 1 Kolaval, therefore, there is no illegality or infirmity in the impugned order.
4. I have heard learned counsel for the parties and perused the material annexed with the petition.
5. True, it is that the petitioner has been transferred from Tahsil Bakawand to Tahsil Karpawand vide order dated 10.07.2025 and he joined there at Karpawand Tahsil on 16.07.2025. However, it transpires from the order dated 21.08.2025, he was assigned duties from Patwari Halka No. 8 to Patwari Halka No. 1, Kolaval on the administrative exigency and smooth functioning of the work of Patwari. When the petitioner was remain in the same Tahsil and only the charge of Patwari Halka number changed it cannot be considered to be a frequent transfer from one place to another and thereby, I do not find any perversity or illegality in assigning the duties of Patwari Halka No. 1,
3 Kolaval to the petitioner by the order dated 21.08.2025 issued by the Respondent No. 3.
6. Accordingly, the there is no merits in the petition and the same is hereby dismissed. Sd/- (Ravindra Kumar Agrawal) Judge Alok
