Present applicant is seeking regular bail in relation to FIR dated 09.08.2024 bearing FIR No. 0024 of 2024, registered at Police Station – Cyber Crime PS Rudrapur, District – Udham Singh Nagar wherein applicant has been implicated for the offences punishable under Section 318 (4), 319 (2), 61 (2) BNS, 2023 and under Section 66-D of the IT Act. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated and in fact, present applicant is victim, since she is an illiterate lady, studied upto 7 standard and in her name a fake company was established. 5. Apart from this, he further submits that charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant. 6. On the other hand, learned State Counsel submits that there is one case of similar nature registered in Panchkula, Haryana, on which applicant has already been enlarged on bail but he fairly submits that since charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant. 7. After hearing learned counsel for the parties and further taking into consideration that charge-sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant and as such, this Court is of the view that applicant deserves for bail. Accordingly, without expressing any opinion on the merit of the case, bail application is allowed. 8. Let the applicant “Rakhi Pachauri” be released on bail, on her furnishing a personal bond and two sureties, each of the like amount, to the satisfaction of the court concerned.
