Learned counsel for the appellant fairly states that while in the present appeal, delay has been condoned by this Court, in other appeals preferred against the same impugned order, the appeals were not condoned and same were dismissed. Learned [2025:RJ-JP:41030-DB] (2 of 2) [CMA-2435/2023] counsel also submits that appeals were dismissed vide order 07.05.2024 passed by the Co-ordinate Bench of this Court. 2. We have considered the contentions. 3. We find that in D.B. Civil Misc. Appeal Nos.2427/2023 and 2436/2023, the challenge is to the order dated 25.08.202 passed by learned Commercial Court No.3, Jaipur Metropolitan-II. The same order is under challenge before us in the present appeal also. Since the final decision has been taken by the Co-ordinate Bench dismissing the appeal treating it to be barred by limitation, we may have condoned the delay in the present case but the final order has to be same as already held by the Co-ordinate Bench in the order dated 07.05.2024. 4. In view of above, the present civil misc. appeal is dismissed on merits, in the same terms. 5. All pending application(s), if any, stand disposed of.
