Sandhawalia, Chief Justice (Oral) It has been brought to our notice that against the interim order passed on 30th December, 2025 by this Court, the State has filed SLP (C) No. 5835 of 2026 and, initially, the operation of the said order had been stayed and the State had been permitted to shift the office of HPRERA to a 1 Whether the reporters of the local papers may be allowed to see the Judgment? Yes -2- place of its choice, which would be subject to the final outcome of the writ petition. 2. However, on a subsequent date, i.e. 22nd May, 2026, certain directions had been issued. It has been noticed that the office would become functional at Dharamshala very soon. Online filing has also been directed and, resultantly, the proceedings in the present case have been ordered to be disposed of, giving liberty to the stakeholders to raise their grievances before the competent authority. The State Government has been directed to look into the said issue. The relevant portion reads as under:- “6. Ms. Madhavi Divan, learned Senior Counsel, appearing for the Appellant-State of Himachal Pradesh, informs that most of the work for shifting has been undertaken and the office will become functional at Dharamshala very soon. 7. We are conscious of the inconvenience that may be caused to the project proponents, home-buyers, other complainants, and especially the advocates from Shimla representing them, who might face difficulty in travelling to Dharamshala. In this regard, we direct for of at the State of Himachal Pradesh to ensure that an online complaints and facilitating filing portal virtual hearings and other online facilities is set up the HPRERA in connection with the office of Dharamshala, thereby permitting the advocates or the complainants from Shimla region to appear online for pursuing their complaints/cases. Such an arrangement, we are quite sure, will redress the grievances of the in and around appellants or other affected persons Shimla. 8. Having passed the above directions and for the see no reason for the reasons mentioned above, we proceedings before the High Court to continue. CWPIL No.38/2025, accordingly, stands disposed of. -3- This order shall be placed on the file of the Writ Petition before the High Court. 9. In the event of any hardship being experienced liberty stakeholder, is granted to seek redressal of such grievances before the competent authority. The State Government will ensure that if any genuine issue arises, the same is resolved without any delay”. 3. Thus, keeping in view the observations made in paragraph 8 of the aforesaid order, we close the proceedings in the present case.
