JUSTICE BUDI HABUNG ORDER Date : 28-02-2025 Heard Mr. T. T. Tara, learned counsel for the applicant and Ms. L. Hage, learned Additional Public Prosecutor for the State. 2. By order, dated 13.02.2025, while calling for the Case Diary, the accused applicant was granted interim anticipatory bail with a direction that in the event the accused applicant is arrested in connection with the Namsai P. S. Case No. Page No.# 2/3 3/2025, under Sections 376(2)(i)-312/315/493 of IPC, he shall be enlarged on bail on executing a bail bond of Rs. 25,000/- with further directions that the accused applicant shall cooperate and appear before the I.O. of the case within 7 (seven) days from the date of the said order. 3. In compliance of the said direction, the accused applicant appeared before the I.O. of the case on 14.02.2025, and on such appearance, the I.O. of the case has examined and recorded his statement under Section 180 of BNSS. 4. Mr. Tara, learned counsel for the applicant submits that since the accused applicant is cooperating with the I.O. of the case, interim anticipatory bail granted to him may be made absolute. 5. Ms. L. Hage, learned Additional Public Prosecutor while referring to the Case Diary submits that as per the record and status report, the accused applicant has appeared before the I.O. of the case in compliance of the direction of this Court, vide order dated 13.02.2025 and he is cooperating with the investigation of the case. She further submits that as the accused is cooperating with the I.O of the case and given his police statement, his custodial remand may not be required. 6. In view of the above and as the accused is cooperating with the I.O. of the case for investigation of the case, the interim anticipatory bail, passed on 13.02.2025, is hereby regularized and made absolute with the same terms and conditions with the further condition that the accused applicant shall appear before the I.O of the case as well as before the Court for trial as and when called for. 7.
