PUBLIC PROSECUTOR The Court made the following ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 and 2 for granting of pre-arrest bail in connection with FIR No.107 of 2024 of Yemmiganur Rural Police Station, Kurnool District, registered for the alleged offences punishable under Sections 126(2), 109 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The petitioners are relatives of the de-facto complainant. The de- facto complainant suffered four injuries, out of them, two injuries are grievous injuries. The Police have filed charge sheet after thorough investigation. Accusation is well founded. 4. Therefore, this Court is not inclined to grant pre-arrest bail to the Petitioners/Accused Nos.1 and 2 as there are specific overacts attributed against them and the de-facto complainant suffered two grievous injuries. 3 Dr.YLR,J CRL.P.No.10678/2025 Dt: 31.10.2025
5. However, the learned counsel for the petitioners requests the liberty of this Court to grant order for surrender of the Petitioners before the learned Trial Court and be released on bail within reasonable time. 6.
Considering the facts and circumstances of the case, gravity and nature of the allegations leveled against the Petitioners/Accused Nos.1 and 2, the Criminal Petition stands dismissed. However, the liberty is given to the Petitioners/Accused Nos.1 and 2 to surrender before the learned Jurisdictional Magistrate concerned within a period of two (2) weeks from the date of receipt of a copy of this order and move an appropriate application before the Court concerned. The Court concerned is directed to dispose of the bail application filed by the Petitioners basing on merits in accordance with law within a period of two (2) days by affording opportunity to the learned counsel for both sides. _______________________ DR.
