Shri Rahul Srivastava, learned counsel for the petitioners contends that the petitioners' pension/family pension are liable to be fixed in light of the Government order dated 21.12.2023. A representation in this regard has been made to the competent authority but to no avail. Learned Standing Counsel submits that the matter requires factual determination and other considerations as per applicable laws by the competent authority in the first instance. However, he fairly contends that the service benefits/claims are liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 4 Deputy Director, Local Funds and Accounts, Kanpur is directed to decide the claim of the petitioner for revision and fix the pension/family pension of the petitioners as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
