GP FOR FINANCE PLANNING 2 The Court made the following: ORDER: This writ petition is filed under Article 226 of Constitution of India with the following prayer for : “…declaring the action of the Respondents in withholding the admitted bill amount viz., for Removal of weed growth in Nadurubada No.2 and 3 channels in irrigation section Ramachadrapuram as per the agreement vide Agreement No87D/2023- 2024 dated 20-09-2023 for an amount of Rs.1,31,515 /- as illegal, arbitrary and violative of Article 14 AND 21 of the Constitution of India and consequently direct the respondents to forthwith consider for payment of the cumulative total amount of Rs. 1,31,515/- with interest @12 PERCENT per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work forthwith in terms of Agreement for Removal of weed growth in Nadurubada No.2 and 3 channels in irrigation section Ramachadrapuram”. 2. The Petitioner was entrusted execution of work for removal of weed growth vide agreement dated 20.10.2023 for the admitted value of Rs.1,58,000/-. The petitioner completed the said work within the stipulated time, after execution of the said work, a final bill for an amount of Rs.1,31,513/- was prepared and submitted for payment, the respondent have not chosen to pay the said amount. Challenging the same the present writ petition is filed. 3. Heard, learned counsel for the petitioner and learned Assistant Government Pleader for Irrigation. 3 4. The learned Assistant Government Pleader have placed on record a copy of instructions issued by the Executive Engineer, Godavari Eastern Division, Ramachandrapuram vide Letter.No.EE/GE.Divn./RCPM/CB/IC2/1184 M; Dated:18.11.2025, wherein it is stated that the bill for payment of an amount to a tune of Rs.1,31,515 /- payable to the petitioner, was prepared and processed, but the same is pending for want of LOC. 5. Having regard to the facts and circumstances and in view of the fact that the bill is pending for want of release of LOC, the respondent authorities are directed to release the amount as admitted, as early as possible preferably within in a period of two (2) months from the date of receipt of a copy of the order. 6.
