This petition purportedly in public interest has been filed by petitioner commanding and directing the respondents to close the brick kiln of respondent no. 6 situated at village Milkinpur, Tehsil - Ghatampur, District - Kanpur Nagar. 2. The record indicates that the said brick kiln has been accorded consent to operate under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 on 04.03.2023 by the U.P. Pollution Control Board and the same is in currency from 01.03.2023 to 31.07.2027. No prayer in the petition has been made seeking to question the said consent to operate dated 04.03.2023. 3. Once consent to operate has been granted by the U.P. Pollution Control Board, there is no question of entertaining the present petition wherein challenge has been laid to running of the brick kiln, which is being run in accordance with law. 4. In case the petitioner has any grievance qua the grant of consent to operate dated 04.03.2023, the petitioner has to take action in accordance with law. 5. No case for entertaining the present Public Interest Litigation is made out and the same is, therefore, dismissed.
