House-wife SSK Biryani House D,No.17-583/2, Rajeshwari Nagar Renigunta, Tirupathi District 517520 ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an Order, Direction or a Writ more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the Respondents 2 to 4 in not acting upon my written complaint thereby violating Art.21 and 300 A of the Constitution of India and also Provisions of Section 155 of The Criminal Procedure Code, 1973 and consequently direct the Respondents 2 to 4 to initiate investigation, failing which we apprehend serious threat to our lives as well as to the property and to pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased Direct the Respondents 2 to 4 to receive and register my complaint and initiate investigation process, pending disposal of the main writ petition and to pass Counsel for the Petitioner: JUPUDI V K YAGNADUTT Counsel for the Respondents: GP FOR HOME THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 27054 OF 2023 The Court made the following order: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an Order, Direction or a Writ more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the Respondents 2 to 4 in not acting upon my written complaint thereby violating Art.21 and 300 A of the Constitution of India and also Provisions of Section 155 of The Criminal Procedure Code, 1973 and consequently direct the Respondents 2 to 4 to initiate investigation, failing which we apprehend serious threat to our lives as well as to the property and to pass such other order or orders…” 2. Heard learned counsel for the petitioner also heard Sri. V.Farooq, learned Assistant Government Pleader for Home representing the respondent Nos.1 to 4. 3. The learned counsel for the petitioner would submit that the respondent Nos.2 to 4 are not acting upon his complaint. 4. The learned Assistant Government Pleader for Home, would submit that, basing on the complaint of the petitioner, a case in Crime No.110 of 2022 under Sections 448, 354, 354 (A) r/w. 34 IPC r/w. 156 (3) Cr.P.C. was registered on the file of Renigunta (U) Police Station Later, the respondent No.6 filed a counter case against the petitioner and 5 others, and the same was registered as Crime No.16 of 2023 under Sections 341, 441, 448, 354, 506 IPC r/w. 34 IPC r/w. 156(3) Cr.P.C. at Renigunta (U) P.S., it is also under investigation. He further submits that the allegations made by the petitioner against the respondent Nos.2 to 4 are false, as there the case is already registered against the respondent Nos.5 and 6. 5. Recording the above submissions, the writ petition is disposed of. There shall be no order as to costs.
