D/L. 5. May 16, 2025. MNS. CPAN 7 of 2025 in WPA No. 27463 of 2023 Chandra Kant Khemka Vs. Mr. Arun Kumar Patra Mr. Chayan Gupta, Mr. Aditya Kanoria, … for the petitioner. Mr. Samriddha Sen, Mr. Sourjya Roy …for the alleged contemnor. Re: CPAN 7 of 2025(contempt application). 1. The affidavit-of-compliance filed on behalf of the alleged contemnor in terms of the order dated April 25, 2025 be kept on record. 2. Heard learned counsel for the parties. 3. It transpires from the affidavit-of-compliance and from the submissions of learned counsel for the parties that the alleged contempt has been purged by the alleged contemnor by issuance of further notices withdrawing/cancelling the fresh notices issued in violation of the order of this Court under Section 13(4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 2 in the same mode and manner in which the incriminating fresh notices were issued. 4. In view of such bona fide action on the part of the alleged contemnor, there is no use in keeping the contempt application pending, since the act of contempt has since been purged. 5. Accordingly, CPAN 7 of 2025 is disposed of as infructuous without any order as to costs. (Sabyasachi Bhattacharyya, J.)
