JUSTICE PRAMIL KUMAR MATHUR
Order 09/10/2025
1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.120/2025 registered at Police Station Jawaja, District Beawar for offence under Sections 140(3), 64(2) (M), 70(1) of BNS.
2. Heard learned counsel for the petitioner, learned Public Prosecutor and counsel for the complainant and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner is tender age of 19 years and victim is of the age of 18 years and this is a case of consensual in nature. He argued that in the present case FIR was lodged on 31.03.2025 but before that husband of the victim has lodged a First Information Report
[2025:RJ-JP:41075] (2 of 2) [CRLMB-12134/2025] against the victim in which statements of the victim have been recorded and the victim herself has stated that she has gone out, with her own free will and nothing wrong has been committed by any person. His further contention is that no video or photograph were recovered from the petitioner and co-accused Pooja Kumari and Sonu have been enlarged on bail on 22.08.2025 The charge- sheet has been filed and the petitioner is behind the bars since
30.04.2025. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Ajeet Kathat S/o Prakash Kathat, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
