Perusal of the record shows that there is only 21 days delay in filing the present revision petition. The delay in filing the revision has properly been explained and the application is duly supported by an affidavit. In view of the above, the present application is allowed and delay of 21 days in filing the revision petition is ordered to be condoned. The application stands disposed of. Cr. Revision No. of 2026 ( Filing No. Cr.R/7711 of 2025) The delay in filing the present revision has been condoned as per order passed in Cr.MP (M) No. 2142 of 2025. It be registered. Cr.MP No. of 2026 ( Cr.MPST NO. 7761 of 2025) It be registered. Notice in the aforesaid terms. Keeping in view the nature of the offence punishable under Section 138 of the Negotiable Instruments Act, execution and operation of the substantive sentence of imprisonment awarded vide judgment dated 23.06.2023 and order of sentence dated 28.06.2023 passed by learned Judicial Magistrate, First Class Nalagarh, District Solan, H.P. (learned Trial Court) in Complaint under Section 138 of N.I.Act registration No. 656 of 2018 as affirmed by learned Additional Sessions Judge, Nalagarh, District Solan, H.P. (learned Appellate Court) in Criminal Appeal No.21 of 2024, decided on 19.04.2025 is ordered to be suspended till further orders subject to deposit of 30% of the compensation amount, if not deposited earlier and the applicant is directed to furnish personal bond in the sum of ₹50,000/- with one surety in the like amount to the satisfaction of the learned Trial Court within a period of four weeks with an undertaking to appear before this Court as and when directed to do so and surrender before the learned Trial Court to receive the sentence, in case of dismissal of the present revision. Trial Court is directed that the bail bonds, so furnished by the applicant/petitioner be transmitted to this Court for placing the same on record. ( Rakesh Kainthla ) Judge 24th July, 2026. (ravinder)
