At the outset, learned counsel for the respondent submits that respondent has filed an application supported with affidavit before the Family Court concerned for withdrawal of proceeding filed under Section 9 of the Hindu Marriage Act, 1955 and a copy of the same is also placed on record along 2 with Covering Memo dated 14.1.2025 for perusal of this Court. However, pursuant to the interim order dated 5.11.2024 passed by this Court, application filed by respondent for withdrawal of proceeding under Section 9 of the Hindu Marriage Act, 1955 is not heard. 2. Learned counsel for petitioner submits that in view of above submission of learned counsel for respondent, based on documents enclosed, he may be permited to withdraw this petition with liberty to repeat the prayer, if any exigency arises in future. 3. In view of the above, this petition is dismissed as withdrawn with liberty as prayed for.
