Learned Single Judge has refused to interfere in the matter after observing that the issue relating to appointments on the post of of Trainee teacher advertised in the year 2011 had traveled up to the Supreme Court where the controversy was ultimately settled by the Supreme Court in the judgment of State of U.P. and others Versus Shiv Kumar Pathak and others, 2018 (12) SCC 595. Remaining vacancy was permitted to be filled by the State by issuing fresh advertisement. It is undisputed that thereafter the vacancies have been advertised and posts have been filled up. In such circumstances, at this late stage, we are not inclined to examine the grievance of the appellant that she was entitled to be called for fourth counseling.
