HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.30838 of 2025 ORDER : The present Writ Petition is filed questioning the inaction of the Respondents in taking steps to restore the contract of the Petitioner to the post of Field Assistant, Chintadavalasa Gram Panchayat, Mentada Mandal, Vizianagaram District and reinstate the Petitioner into service by paying the arrears of salaries due from July, 2023 onwards as illegal and arbitrary. 2. The Petitioner was initially appointed as Rozgar Sevak of Ippalavalasa Gram Panchayat, Mentada Mandal vide proceedings Procs.No.298/2011/GS/SA-1 dated 13.03.2012. eversince, the Petitioner has been discharging his duties as Rozgar Sevak and has been reporting to the jurisdictional MPDO. While so, Ippalavalasa Gram Panchayat was bifurcated and formed into Chintadavalasa Gram Panchayat and the Petitioner was posted as Field Assistant in Chintadavalasa Gram Panchayat. However, the formation of Chintadavalasa Gram Panchayat was not found in the NIC software as such no works were entrusted during the period from 2024-25 and the contract service of the Petitioner was terminated vide Procs.R.C.No.1601/2025/H.R.M.S. dated 22.05.2025 on the ground 2 that the Petitioner could not provide 7500 working days in the year 2024-25, but have provided work for 5474 days. Pursuant thereto, the Petitioner submitted a detailed representation on 09.06.2025 to Respondent Nos.3 and 4 bringing to their notice the factual issues and requested for reinstatement as Field Assistant. The Mandal Parishad Development Officer (FAC), Mentada examined the representation of the Petitioner and submitted a letter to the Project Director, District Water Management Agency, Vizianagaram vide Letter No.20/GS/2025-26 dated 11.06.2025, wherein it is mentioned that due to formation of new Gram Panchayat as Chintadavalasa Gram Panchayat from July, 2023, the name of the Petitioner did not appear in NIC software and hence, no works can be assigned during that period. It is also mentioned in the letter that the Petitioner did not receive salary for 23 months. 3. As no further sanction was taken vide letter dated 11.06.2025, the present writ petition is filed. 4. Learned standing counsel Sri M.S.R.Murthy, submits that he representation of the Petitioner along with letter of Respondent No.4 would be considered and appropriate orders will be passed. 5. Considering the submissions made, the writ petition is disposed of directing the Respondents to consider the 3 representation of the Petitioner dated 09.06.2025 taking note of the letter dated 11.06.2025 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
