Nos. 397/1, 396/3, 388/3, 398/4, 389/4, 388/1, 389/4,5, 62/2,7, 390/1,8, 389/1, 399/1, 398/1,2, 389/2, 398/4, 399/1,2, 398/3, 398/5, 396/1,2,3, 397/1 and 388/2 in Re.Sy.Block No.9 of Elamkunappuzha Village, Kochi Taluk, Ernakulam District. For the purpose of cultivation he needs to use the machineries for strengthening the bund around the fields. Therefore the petitioner submitted Ext.P3 application before the 1st respondent seeking permission for the same. The limited relief sought by the petitioner is to direct the 1st respondent to consider and pass appropriate orders on the same. After hearing the learned counsel for the petitioner and the learned Government Pleader, I am inclined to dispose of this writ petition. Accordingly, it is ordered that, the 2nd respondent shall take up Ext.P3 application and a decision on the same shall be W.P.C No. 9180 of 2025 4 2025:KER:24287 taken within a period of one month from the date of receipt of a copy of this judgment, after giving the petitioner an opportunity for being heard. . It is further directed that, while considering the same, the observations made in Ext.P5 judgment passed by this Court in similar circumstances shall also be taken into account.
