ORDER The Criminal Petition has been filed under Sections of the Code of Criminal Procedure, 1973 (for brevity ‘ 437 and 439 the Cr.P.C.’)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioner/Accu sed on bail in Crime.No. 169 of 2024 of Vizianagaram Rural Police Vizianagaram District, registered against the petitioner/Accused herein for the offences punishable under Sections 8 (c) of the Narcotic Drugs and Psychotropic Substances Act brevity ‘the NDPS Act’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record the allegation against the petitioner/Accused No.10 is that he had indulged in dealing with 22.00 kgs of ganja, which is a commercial quantity. Originally, Accused Nos.1 and 3 were arrested, and they gave confessions against Accused and 6 were arrested and gave confessions against the present petitioner/Accused No.10 on 26.06.2025. The petitioner/Accused No.10 Nos.5 and 6 on 19.08.2025. Subsequently, Accused Nos.5 was arrested on

The learned counsel for the petition^r submits that the petitioner is a permanent resident of Dumbbaguda Village, Pedabayalu Mandal, ASR District, and he has got fixed abode. If he is enlarged on bail, he may not evade the process of law. So far, five witnesses have been examined. The material portion of the investigation, insofar as the alleged role played by the petitioner is concerned, has been completed. The petitioner is not in a position to threaten the witnesses, tamper with the evidence, or hamper the investigation, as the witnesses are official witnesses. Except the confessions of Accused Nos.5 and 6 there is no material on record incriminating the petitioner/Accu sed No.10. 5. Considering the facts and circumstances of the case, the nature and gravity of alleqations levelled against the petitioner/Accused No.10,

YLR, J Crl.P.No.l0755 of2025 Dated 29.10.2025 this Court is inclined to enlarge the petitioner/Accused No. 10 on bail with the following stringent conditions: i. The petitioner/Accused No. 10 shall be enlarged on bail subject to he executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for the like sum each to the satisfaction of the learned Additional Judicial Magistrate of First Class, Vizianagaram. ii. The petitioner/Accused No. 10 shall appear before the Station House Officer concerned on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet. iii. The petitioner/Accused No. 10 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned, iv. The petitioner/Accused No. 10 shall not commit or indulge in commission of any offence in future. V. The petitioner/Accused No. 10 shall not, directly indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as or
