Heard the parties.
Petitioner has been made accused in connection with Patratu (Barkakana) P.S. Case No. 213/2024, registered under Sections 338/ 336(3)/ 340 (2)/ 318(4)/ 316(2)/ 61(2) of the B.N.S., 2023, pending in the Court of Sri Rohit Kumar, learned J.M.F.C., Ramgarh. On 13.08.2024, Barkakana police, on the basis of suspicion, intercepted a Baleno car and apprehended this petitioner alongwith co- accused persons. On search, Rs.3.86 lakhs were recovered from the said vehicle. It is alleged that the petitioner used to dupe the innocent persons on the pretext that they will double their money.
Learned counsel appearing on behalf of the petitioner submitted that no victim has come forward to state that this petitioner has cheated anyone. It was further submitted that several co-accused persons who are apprehended at the spot, have been granted bail by this Court earlier. Learned A.P.P. has opposed the prayer for bail and submitted that petitioner is resident of Gazipur (U.P.).
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Sri Rohit Kumar, learned J.M.F.C., Ramgarh or his successor, in connection with Patratu (Barkakana) P.S. Case No. 213/2024.
