After hearing Mr. Mohod, learned Counsel for the applicant and Mr. Bansod, learned Counsel for the respondent for some time, it appears that final order of maintenance dated 11/06/2024, passed by the Judicial Magistrate First Class, Kelapur in P.W.D.V.A. Application No.30/2017 below Exh.39 is under challenge in the present Revision Application. The applicant is having statutory remedy of filing appeal under Section 29 of the Protection of Women from Domestic Violence Act, 2005. The delay in filing Revision Application is already condoned. 2. Mr. Mohod, learned Counsel for the applicant, upon instructions from the applicant, seeks permission to withdraw the present Revision Application, as this Court was not inclined to entertain the Revision Application. 3. Criminal Revision Application is disposed off as withdrawn with liberty to the applicant to file an appeal before the learned Sessions Judge, challenging the impugned order of final maintenance passed by the learned Judicial Magistrate First Class, Kelapur. The delay, if any, in filing appeal shall be condoned by the learned Appellate Court taking into consideration that wrong remedy of Revision is pursued by the present applicant. 5.
