2 Hon'ble Shri Justice Arvind Kumar Verma Order on Board 02/09/2025
1. By way of this petition, petitioner sought the following relief(s) :
“10.1 That, this Hon'ble Court may kindly allow the petition and quash the impugned order 27.05.2025 PASSED BY RESPONDENT NO.2 (ANNEXURE P/1) and impugned letter DATED 27.05.2025 PASSED BY RESPONDENT NO.3 (ANNEXURE P/2) in the interest of justice. 10.2 That, the respondents may kindly be directed to act in accordance with the rationalization instructions in accordance with law. 10.3 Any other relief which deemed fit and proper may also be issued looking to the facts and circumstances of the case and looking to the interest of the petitioner.”
2. Learned counsel appearing for the petitioner contended that the petition is against the particular order by which the Primary School Jarhajhel Block Katghora District Korba has been merged into Primary School, Durpa though in between both the schools the distance is more than 1.5 kms and the same is contrary to the rationalization policy because in the rationalization policy, it has been duly mentioned that the school which is in a shorter distance of 500 meters has been prescribed for merger of the school in the city level. So, the impugned merger of the Primary School, Jarhajel into Primary School, Durpa situated at village Durpa is totally contrary to the Government rationalization scheme.
So the order impugned which relates to merger of Primary School, Jarhajel in the Primary School Durpa is totally
3 erroneous and contrary to their own rationalization policy. So the order impugned which relates to the merger of another school situated at Primary School, Jarhajel in the Primary School, Durpa is totally against the rationalization policy. Hence, this petition. 3. Learned counsel for the State opposes the submission made by counsel for the petitioner and contended that petitioner has no locus to challenge Annexure P-1 & Annexure P-2. 4. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering the facts and circumstances of the case and submission made by learned counsel for the parties. Taking into consideration the fact that the relief which has been sought by the petitioner cannot be granted in exercise of writ jurisdiction and the petitioner has no locus to challenge the Annexure P/1 and Annexure P/2, in view of the considered opinion of this Court, no case is made out for any interference. 6. Accordingly, the petition being devoid of any merit is liable to be and is hereby dismissed. Sd/-
