Counsel for the applicant-petitioner submits that when the matter was listed before this Court on 04.02.2025, the counsel could not appear and in his absence, an order was passed on the basis of submission made by the State counsel, that the petitioner himself has abandoned and discontinued the service, hence, cause of action has not survived with him to continue with the writ petition. Counsel submits that the aforesaid statement made by the State counsel is factually incorrect, (2 of 2) [WMAP-42/2025] because the petitioner is still continuing on the post of Data Nodal Officer and he has completed more than 10 years of service, hence, the order dated 04.02.2025 be recalled and the writ petition bearing No.7920/2009 be restored to its original number. 2. Counsel for the non-applicants/respondents have no objection. 3. Considering the above submissions made by counsel for the petitioner, the instant application stands allowed and the order dated 04.02.2025 stands recalled. 4. S.B.
