GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus questioning the highhanded action of the 2' Respondent and the Police officials of Machavaram Police Station, NTR Commissionerate, in threatening the 1st Petitioner and its employees to close down the spa business being carried out at D.No.40-1-48/2, 3rd 2 Floor, Valluri Complex, Opp. MandM Showr000m, M.G. Road, Vijayawada, and their further action in interfering with the business activities of the 1st Petitioner and preventing the 1St Petitioner from running its business at the aforesaid premises from 14.10.2022 to date, without issuing any notice or following the due process of law. as arbitrary, illegal, unjust, violative of the principles of natural justice, violative of the fundamental and constitutional rights guaranteed under the Constitution of India and contrary to law, and for issuance of a consequential direction to the Respondents not to interfere with the lawful business activities of the 1st Petitioner at the aforesaid premises.” 2. Sri Ramakrishna Pativada, learned counsel for the Petitioners would submit that, they have no instructions from the Petitioners. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that, in the light of the interim order dated 28.12.2022 passed by this Court, Police are not interfering in the lawful business of the Petitioners. It is further submitted that, the petition may be disposed of giving liberty to the Police to take appropriate action in the event of any illegal activities committed by the Petitioners under the guise of Spa business. 4. Recording the same, the Writ Petition is disposed of. However, it does not preclude the Police from taking appropriate action in case of any unlawful activities are done under the guise of Spa. There shall be no order as to costs.
