The applicant Robin @ Himanshu is in judicial custody in Case Crime No. 507 of 2023, under Sections 276, 419, 420, 471 IPC, Police Station Kotwali Gangnahar Roorkee, District Haridwar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant would submit that nothing was recovered from the applicant; when the police raided the premises, the applicant was not present; merely, based on the statement of the co-accused, he has been named in the offence; charge sheet has already been filed. It is also argued that one of the co-accused Avdhesh Kumar Tyagi having similar role has already been granted anticipatory bail by this Court on 02.01.2025.

Learned State Counsel would submit that the applicant used to purchase the medicines from the co-accused Amit Dhiman and he had given a demand order, and had also paid Rs. 4,00,000/- to the co-accused.

Learned counsel for the applicant would submit that he did not pay any amount with regard to the offence in question.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
