The petition coming on for hearing, upon perusl'ng the petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Y.LATCHANNA, Advocate for the petitioner and of PUBLIC PROSECUTOR for Respondent, the court made the following ORDER J7 THE HONOURABLE SRI JUSTICE T MALLIKARJUNA RAO CRIMINAL PETITION No: 604 of 2025 Order:- This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A9, seeking regular bail, in Crime No.240 of 2023 of Gokavaram Police Station, East Godavari District, registered for the offences punishable under Sections 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act,1985 (for short tthe NDPS Act'). 2. Brief facts of the case are that, on 06.07.2023, on receipt of credible information, the Sub-Inspector of Police along with his staff and mediators rushed to Sri Surya Durga Bapanamma Stone Crusher, Outskl-rts of Ramannapalem VI'llage, Gokavaram mandal and found accused in possession of 54Kgs of ganja. The contraband along with other material was seized under the cover of mediators report. 3. Heard. Perused the record. 4. Learned counsel forthe petitionercontendsthat basing on the confessional statement of Al to A6, the petitioner herein is arrayed as accused in the present crime. Except the said £ _-xp®i=--J_=` 2 J, confessional statement, no contraband has been seized from the petitioner to connect him in the commission of offence. 5. Learned counsel for the Petitioner Placed the copies Of the bail orders of other accused in the present crime, wherein the learned sessions Judge granted bail to Al to A6 and A12 in the present crime. 6. On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the pet-ltioner on the ground that there are two antecedents reported against the petitioner herein previously. , 7. As seen from the orders Placed bythe learned counsel for the petitioner, the learned sessions Judge granted bail to Al to A6, A12 on the ground that charge Sheet iS not filed after lapse of 180 days. lt seems that based On the confessional Statement of Al to A6, the present crime came tO be registered against the petitioner herein. ]t is submitted that the petitioner herein has been remanded to judicial custody on 07.01.2025. 8. ln view of the facts and Circumstances Of the Case, this court finds that further detention of petitioner is not required for the purpose of investigation. lt is submitted that the petitioner _ -I:_* € <fi=ct_ L]-RE had permanent abode and there is no possibility of his fleeing away from the justice and the release of the petitioner would not cause hampering of investigation or tampering of witnesses, this Court is inclined to grant bail to the petitioner herein/A9, on the following conditI-OnS. (i) The petitioner/A9 shall be released on executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional Judicial Magistrate of First Class, Rajamahendravaram. (ii) On release, the petitioner shall appear before the Station House Officer, concerned, once in a week i,e., on every Sunday between 10.00 a.m. and 01.00 p.m., for a period of three (3) months. (I'ii) The petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. 9.
