At the outset, learned counsel for the petitioner would submit that due to inadvertencehe has filed the present criminal misc. petition against the order dated 29.09.2022, whereas the order of dismissal of the complaint case for want of prosecution having effect of the acquittal of the appellant as provided under Section 256 of Cr.P.C., therefore, he has required to file acquittal appeal. 2. In view of the above, he does not want to press present criminal misc. petition with liberty to avail appropriate remedy available under the law. 3.
