ORDER: The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:
“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the action of the Respondent No.5 in interfering with the petitioners peaceful possession and enjoyment of the property situated in (i) Sy. No. 39/10 of an extent of Ac. 0.20 cents (ii) Sy. No. 39/3A of an extent of Ac. 0.25 cents (iii) Sy. No. 22/11 of an extent of Ac. 0.37 cents and (iv) Sy. No. 22/10 of an extent of Ac. 0.19 cents at Pachigunta Village, Gangadhara Nellore Mandal, Chittoor District, Andhra Pradesh as illegal, arbitrary, unconstitutional and being violative of articles 14, 21 and 300(A) of the constitution of India and in violation of principles of natural justice and consequently direct the respondents not to interfere in the petitioners peaceful possession and enjoyment of the property situated in (i) Sy. 2. Heard Sri P.Jagadish Chandra Prasad, learned counsel for the petitioner, learned Assistant Government Pleader appearing for respondents.

Without going into the merits of the case, it is submitted that subsequent to grant of patta, on the complaints made by some third parties, the respondents have conducted survey by following the procedure contemplated under the Act by issuing notices to the petitioner and subsequent to the survey, the authorities have also

issued appropriate proceedings and as of now, the respondents are not interfering with the possession of the petitioner over the subject property and if at all the respondents intend to evict the petitioner from the subject property, they will follow due process of law.

Learned counsel for the petitioner submitted that, by recording the submissions of the learned Assistant Government Pleader appearing for respondents, the Writ Petition may be disposed of.
6. In view of the same, the Writ Petition is disposed of directing the respondents not to interfere with the peaceful possession of the subject property by the petitioner, without following due process of law. No costs.
As a sequel thereto, interlocutory applications pending, if any, in the writ petition, shall also stand closed.
