This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.706/2024 registered at Police Station Ambikapur, District GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.09.10 17:48:04 +0530
2 Sarguja (C.G.) for the offence punishable under Section 21 (C) of Narcotic Drugs and Psychotropic Substance Act, 1985. 2. Case of the prosecution, in brief, is that the police of concerned Police Station had received secret information from the informant and on the basis of the said information conducted a raid and seized 58 pieces of the Talgesic Buprenorphine injection IP 02 ML and 58 pieces of Avil Pheniramine Maleate Injection IP 10 ML vials, total 116 pieces from the joint possession of the present applicant and other co- accused persons. Thereafter the police registered the offence punishable under Section 21 (c) of NDPS Act against the present applicant. 3. Learned counsel for the applicant submits that the first bail application was rejected by this Court on merits vide order dated 22/01/2025 in MCRC No.619/2025, therefore this second bail application is filed on the ground that seizure witnesses have turned hostile, further charge-sheet has already been filed in the present case, the applicant is in jail since 11/10/2024 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, it transpires that this is the second
3 bail application of the applicant and first bail application of the applicant was rejected on merits by this Court vide order dated 22/01/2025 in MCRC No.619/2025.
Only ground which has been raised in this second bail application is that seizure witnesses have turned hostile which cannot be a ground to entertain this second bail application. 7. Accordingly, the second bail application of the applicant- Prince @ Shashwat Tiwari, involved in Crime No.706/2024 registered at Police Station Ambikapur, District Sarguja (C.G.) for the offence punishable under Section 21 (C) of Narcotic Drugs and Psychotropic Substance Act, 1985, is rejected. 8. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial expeditiously, preferably within a period of four months from the date of receipt of this order in accordance with law, if there is no legal impediment. 9.
