This is a bail application U/S.483 of the BNSS by the petitioners for grant of bail in connection with Sindhekela PS Case No. 165 of 2024 corresponding to SC Case No. 58 of 2024 pending in the Court of learned Addl. Sessions Judge, Kantabanji for commission of offences punishable U/Ss. 341/302/294/506/34 of IPC, on the main allegation of committing murder of the deceased Swada Rana by assaulting him with stones in furtherance of their common intention. 3. Heard, Mr. Braja Kishor Panda, learned counsel for the Petitioners and Mr. R.B. Mishra, learned Addl. PP in the matter and perused the record including the deposition of PW1 to PW7. 4. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-a-vis the allegation sought to be brought against them and regard being had to the evidence of eye witnesses- cum-PW1 & PW7 and taking into account the law laid down by the Apex Court in X Vrs. State of Rajasthan; (2024) SCC OnLine SC 3539, this Court is not inclined to grant bail to the Petitioners. Hence, the bail application of the petitioners stands rejected.
