PUBLIC PROSECUTOR 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA I.A.Nos. 2 and 3 of 2025 In/and CRIMINAL PETITION Nos. 11554 & 11552/2025 COMMON ORDER: The instant Criminal Petitions under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) have been filed by the Petitioners/Accused Nos.1 & 2, seeking quashment of proceedings pending against them in C.C.No.1897 of 2023 against the Accused No.1 and C.C.No.1843 of 2017 against the Accused No.2, on the file of the learned I Additional Chief Metropolitan Magistrate, Visakhapatnam. 2. I.A.No.2 of 2025 has been filed by the Respondent No.2 to accord permission to the Respondent No.2 to compound the matter in C.C.No.1897 of 2023 against the Accused No.1 and C.C.No.1843 of 2017 against the Accused No.2, on the file of the learned I Additional Chief Metropolitan Magistrate, Visakhapatnam. 3. I.A.No.3 of 2025 has been filed by the Respondent No.2 to accord permission to the Respondent No.2 to quash the proceedings pending in C.C.No.1897 of 2023 against the Accused No.1 and C.C.No.1843 of 2017 against the Accused No.2, on the file of the learned I Additional Chief Metropolitan Magistrate, Visakhapatnam. 4. Heard Sri R.Siva Sai Swarup, learned counsel for the Petitioners, Sri J.Varun Roy, learned Counsel for the Respondent No.2 and 4 Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State. 5. Learned Counsel for the Petitioners would submit that initially, the Court has taken cognizance vide C.C.No.1843 of 2017 against the Accused. Later the case was split up against the Accused No.1 and renumbered as C.C.No.1897 of 2023. 6. Accused No.1 did not appear before this Court. However, Accused No.2 appeared before this Court who is representing Accused No.1, since he is the G.P.A Holder for Accused No.1 and Respondent No.2 also appeared before this Court and were identified by the learned counsel for the Petitioners and the learned Counsel for the Respondent No.2. 7. The Respondent No.2 appeared before this Court and would submit that they have settled the matter amicably before the elders. She has no objection to quash the case against the Petitioners, since there is no dispute between them, as both the parties have agreed to get divorce by mutual consent. She has further submitted before this Court that they have filed FCOP, before the Family Court, Visakhapatnam, for getting divorce by mutual consent. 8. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate Orders. 9. Considering the submissions made by the Respondent No.2, and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of 5 Punjab and another1, since there is an amicable settlement between the parties, the I.A.Nos.2 and 3 of 2025 are allowed. Consequently, these Criminal Petitions are allowed, quashing the proceedings pending against the Petitioners/Accused Nos. 1 and 2 in C.C.No.1897 of 2023 against the Accused No.1 and C.C.No.1843 of 2017 against the Accused No.2, on the file of the learned I Additional Chief Metropolitan Magistrate, Visakhapatnam.
