[2025:RJ-JP:15807] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous (Petition) No. 1063/2025 Seema Jain W/o Nirmal Kumar Jain, R/o Jhalrapatan, P.S. Jhalrapatan, District Jhalawar. ----Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Ravindra Saini for Mr. Ravi Kumar Sharma For Respondent(s) : Mr. Manvendra Singh Shekhawat, PP with Mr. Rishi Raj Singh Rathore, PP HON'BLE MR. JUSTICE SAMEER JAIN Judgment 09/04/2025 1. Present petition is filed under the provisions of Section 528 of BNSS against the impugned order dated 28.01.2025 whereby an application filed by the petitioner with a prayer to get the signature on the cheque re-examined by the Forensic Science Laboratory for FSL has been dismissed. The observations of the learned Trial Court are reproduced as under:- “mHk; i{kksa ds rdksZa ij euu fd;kA i=koyh dk voyksdu fd;k x;kA i=koyh ds voyksdu ls ;g izdV gS fd izdj.k esa izkFkhZ;k@vfHk;qDrk ds fo:) /kkjk 420] 467] 468] 471 Hkk-n-la- ds vijk/k dk vk{ksi gSA izdj.k orZeku esa lk{; lQkbZ ds Lrj ij fu;r gSA izkFkhZ;k }kjk vius izkFkZuk&i= ds ek/;e ls ,Q-,l-,y- fjiksVZ izn’kZ ih-54 ds laca/k us mDr fjiksVZ dks tkjhdrkZ lgk;d funs’kd] fof/k foKku iz;ksx’kkyk jktLFkku t;iqj dks lk{; esa ryc djok;s tkus dh izkFkZuk dh gS fdarq vfHk;qDrk us vius izkFkZuk&i= esa ;g Li"V ugha fd;k gS fd og mDr xokg dks ryc dj fdl rF; dks LFkkfir djuk pkgrh gS rFkk i=koyh ij vkbZ lk{; esa dksbZ ,slk rF; Hkh ugha vk;k gS ftlls fd ,Q-,l-,y- fjiksVZ izn’kZ ih-54 ij dksbZ vfo’okl izdV gksrk gks rFkk n-iz-la- dh /kkjk 292 o 293 ds vuqlkj iz’uxr [2025:RJ-JP:15807] (2 of 2) [CRLMP-1063/2025] nLrkostksa ds ljdkjh ijh{kd ;k iz’uxr nLrkostksa ds jkT; ijh{kd dh LogLrk{kfjr fjiksVZ fdlh tkap] fopkj.k ;k vU; dk;Zokgh esa mUgsa lk{kh ds rkSj ij ugha cqyk;s fcuk Hkh lk{; esa mi;ksx esa ykbZ tk ldrh gSA ,slh fLFkfr esa izkFkhZ;k@vfHk;qDrk us mDr xokg dks U;k;ky; ds le{k lk{; gsrq ryc djok;s tkus dk dksbZ Ik;kZIr o leqfpr vk/kkj@dkj.k nf’kZr ugha fd;k gS] vfHk;qDrk dh vksj ls mDr izkFkZuk&i= dsoy izdj.k dks foyEc dkfjr djus ds vk’k; ls is’k fd;k tkuk izdV gksrk gSA vr% vfHk;qDrk dh vksj ls izLrqr izkFkZuk&i= vLohdkj dj [kkfjt fd;k tkrk gSA izdj.k vksYMsLV VkjxsVsM ua- 7 gSA vr% vfHk;qDr lk{; lQkbZ esa dksbZ xokg is’k djuk pkgrh gS rks vkxkeh is’kh ij vko’;d :i ls is’k djsA i=koyh okLrs lk{; lQkbZ fnukad 01-02-2025 dks is’k gksA” 2. Upon perusal of the same, this Court has noted that while rejecting the said application, learned Trial Court has considered the following aspects:- 2.1 That trial is at the stage of evidence. 2.2 That the application which is filed qua FSL report (P-54) and allied matters is vague and unclear as accused/petitioner has not clarified why she wants to get the FSL Investigation done again. 3. Considering the observations made by the learned Trial Court, taking note of the fact that matter pertains to the Year 2016 and an application filed to get the signature on the cheque re-examined by the Forensic Science Laboratory for FSL was rightly dismissed by the learned Trial Court, that order dated 28.01.2025 is a speaking order, thus this Court finds no reason to interfere with the said order. 4. Accordingly, the present petition is dismissed. Pending applications, if any, shall stand disposed of. (SAMEER JAIN),J JKP/42
