1.PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the BharatiyaNagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in NSC.No.60 of 2007 on the file of the learned I Additional District and Sessions Judge-cum-Special Court for
2 NDPS Cases at Visakhapatnam, registered against the Petitioner/Accused No.1 herein for the offences punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The allegation against the Petitioner/Accused No.1, as seen from the record is that, he acted as a driver and also a pilot for transportation of 320 Kgs of Ganja in the year 2007. As the Petitioner was absconding, NBW was issued in the year
2012. The Petitioner had not immediately either surrendered before the learned Magistrate or before the Investigating Officer. After the learned Magistrate has initiated steps for proclamation, on 18.07.2025, the Petitioner himself surrendered before the court concerned. In this case, after thorough investigation, chargesheet was filed. It was given number as NSC.No.60 of 2007. Petitioner is permanent resident of Idgha Mohalla (V Rajganjpur), post and Taluka, Sundaraghad District, Orissa. He has got fixed abode. He has been in the judicial custody for the past 108 days. No schedule has yet been issued. If the Petitioner is enlarged on bail with certain stringent conditions, he may not evade from the process of law, inasmuch as he himself surrendered before the learned Court concerned. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.1, this Court is inclined to enlarge the Petitioner/Accused No.1 on bail. 3

In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.1 shall be enlarged on bail subject to he executing bond for a sum of Rs.50,000/- (Rupees fifty thousand only), with two sureties each for the like sum each to the satisfaction of the learned I Additional District and Sessions Judge-cum-Special Court for NDPS Cases at Visakhapatnam. ii. The Petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iii. The Petitioner/Accused No.1 shall not commit or indulge in commission of any offence in future. iv. The Petitioner/Accused No.1 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. _________________________ DR.
