Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 01-08-2025 1) By way of this petition, petitioner has sought following reliefs:- 10.1 This Hon’ble Court may be pleased to issue a writ of mandamus directing the respondent No. 2 to consider the case of petitioner for the post of Rural Health Convenor – Male for appointment at Bilaspur District in 2 unreserved quota and in case the posts are filled up, the petitioner humbly submits that the respondent may be directed to keep one post vacant for the petitioner subject to outcome of the result of the writ petition. 10.2 That, any other writ, directions or relief which this Hon’ble Court may deem fit may kindly be passed in favor of petitioner. 2) Facts of the present case are that an advertisement was issued by Director, Directorate, Health Services i.e. respondent No. 2 on 04.08.2016 for appointment to the vacant and back-log posts of Rural Health Convenors across various districts of the State. The eligibility criteria was - (i) candidate must be resident of State of Chhattisgarh and (ii) candidate must possess live registration with the Chhattisgarh Para-medical Council. Petitioner submitted his application form and participated in the written examination and thereafter, results were declared. Petitioner found place in Wait List. It is pleaded that petitioner suffers from permanent disability of more than 40% over the leg but his name was not considered for appointment. 3) There is no representation on behalf of petitioner in two rounds. 4) Learned State counsel submits that 16 posts were advertised for District-Bilaspur, out of which 8 posts were for UR category ; 2 posts were for SC category ; 5 posts were for ST category and 1 post for OBC category. She further submits that the said recruitment drive was specially for physically handicapped candidates and pursuant to recruitment process, appointments 3 have already been made and petitioner has not arrayed the selected candidates as party-respondents. She contends that petitioner found place in the Wait List and all the selected candidates have already joined the services. She further contends that as all the posts in the recruitment process were earmarked for physically handicapped persons, therefore there was no occasion for the respondent authorities to give preference to the petitioner. She prays that this petition deserves to be dismissed. 5) Heard. 6) Evidently, petitioner belongs to UR category and he was placed in the Wait List. The selected candidates have already joined the services and they have not been arrayed as party-respondents in the present petition. In this petition, petitioner has sought a direction to the respondents to consider his case for appointment but has failed to establish his claim for selection and appointment to the post of Rural Health Convenor (Male). Petitioner has also not pleaded bias, malafide and arbitrary action on the part of respondents. 7) Taking into consideration the above-discussed facts, no case is made out for interference.
