Neutral Citation No. - 2025:AHC:56234 Court No. - 6 Case :- WRIT - A No. - 4824 of 2025 Petitioner :- Sateesh Chandra Rai Respondent :- State Of Uttar Pradesh And 4 Others Counsel for Petitioner :- Aditya Upadhyay,Ambrish Pandey Counsel for Respondent :- C.S.C.,Shashi Prakash Singh Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Ambrish Pandey, learned counsel for the petitioner and Sri Shashi Prakash Singh for respondent nos. 3 to 5.
2. Petitioner has approached this Court that his wife had taken (V.R.S.) on 30.12.2023 and gratuity was also paid to her in June,
2024. However, her claim for interest remained pending and unfortunately she died on 13.11.2024, and now the petitioner has approached this Court that he is entitled for interest on delayed payment of gratuity paid to his late wife.
3. It is not disputed that petitioner is getting family pension, though probably he may not be entitled for that. However, Court is not entering into said issue.
4. Wife of petitioner was entitled for gratuity which was paid to her within a short period i.e. in June, 2024 (within less than 6 months) which would not invite any interest as there is no extraordinary delay. Said short period may be due to procedural delay. Otherwise also, interest, if any, could be paid to deceased wife of the petitioner and not to the petitioner after his death, therefore, on above both grounds, claim of the petitioner is not legally sustainable.
5. Writ Petition is accordingly dismissed. Order Date :- 17.4.2025 SB Digitally signed by :- SANDEEP BHATTACHARYA High Court of Judicature at Allahabad
