[2025:RJ-JP:3362] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Application No. 34/2025 Amit S/o Krishan Kumar, Aged About 27 Years, R/o Maham, Police Station Maham, District Rohtak, Haryana. ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Majhar Hussain For Respondent(s) : Mr. R.S. Shekhawat, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 23/01/2025 The application filed in the S.B. Criminal Misc. Bail Application No.14294/2024 for seeking modification of order passed by this Court vide order dated 03.01.2025 wherein, in Para No.7 after enlarging the petitioner on bail, the accused-petitioner was directed to mark his presence on 25th of every month till conclusion of trial before the concerned Police Station. It is contended by learned counsel for the petitioner that he is a resident of Rohtak and the condition imposed upon the petitioner is onerous. It is difficult for the petitioner to travel from Rohtak to Police Station Singhana, District Jhunjhunu on 25th of every month, therefore, the condition imposed be modified or altered. In alternative, the accused-petitioner may be directed to appear before the concerned Police Station on such date as and when the date of trial is fixed. The accused-petitioner in support of its argument has cited Para No. 58 of the judgment of Satender [2025:RJ-JP:3362] (2 of 2) [CRLMA-34/2025] Kumar Antil Vs. Central Bureau of Investigation & Anr. 2022 LiveLaw (SC) 577. Learned Public Prosecutor has vehemently opposed the grant of modification application. Further, it was brought into notice of the Court that the petitioner was involved in other criminal cases and against him four cases were registered under various offences, therefore, the condition imposed upon the petitioner is not harsh rather it would bound the petitioner not to commit any offence in future, in light of the same, the modification application may be dismissed. Heard and perused the material available on record. The bail application of the petitioner was granted vide order dated 03.01.2025 and condition No.7 was imposed on the grounds that the petitioner was involved in four other criminal cases committed under various offences of IPC and BNS. The case of Satender Kumar Antil (Supra) referred by the counsel for the petitioner is not relevant to the present case, this Court do not find any reason to modify the condition No.7 mentioned in the order dated allowing the bail application. Hence, the S.B. Criminal Misc. Application for modification is hereby dismissed. (PRAVEER BHATNAGAR),J Keshav/18
