2 Dr.YLR,J CRL.P.No.10853/2025 Dt: 31.10.2025 The Court made the following ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused for granting of pre-arrest bail in connection with Crime No.301 of 20 2025 of Rajahmundry III Town Police Station, East Godavari District, registered for the alleged offence punishable under Section 108 of Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) on the allegation of abetment of suicide. 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. The petitioner is aged about 38 years, his first wife died, he is a private employee and he wanted to go for second marriage. The daughter of the de- facto complainant (the deceased) is aged about 35 years, her husband also died and she was also planning to go for second marriage. There was an alliance convened for the marriage of the petitioner and the deceased. Later there arose certain disputes between the petitioner and the deceased. The mother of the deceased lodged a complaint alleging that the petitioner harassed the deceased mentally and threatened that he would post certain intimate photos of deceased and petitioner in social media and blackmailed her. He also coerced the deceased to marry him.
The daughter of the de-facto complainant took an extreme and consumed pesticide. Later while undergoing treatment, she was succumbed to poison consumption. 4. Learned counsel for the petitioner filed certain documents including Whatsapp messages in between the petitioner and the deceased. 5. Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioner, this Court is inclined to grant pre-arrest bail to the Petitioner/ Accused. 6. In the result, the Criminal Petition is allowed with the following conditions:

In the event of arrest of the Petitioner/Accused he shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/Accused shall make himself available for investigation as and when required; iii. The Petitioner/Accused shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioner/Accused shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioner/Accused shall surrender his passport, if any, to the investigating officer.
