Heard Sri.Kumara K. G., learned counsel for the petitioner. Respondent not appeared though notice of the petition is served on the lawyer who represented the respondent in the Trial Court.
2. Wife has filed the present petition with the following prayer:
“WHEREFORE, the petitioner most humbly prays that this Hon’ble Court may kindly be pleased to order for transfer of the MC petition, which is pending on the file of Hon’ble 5th Additional Principal Judge, Family Court, Bengaluru in MC No.3882/2024 to the Hon’ble Family Court, Mandya, in the interest of justice and equity.”
3. Facts of the case which are utmost necessary for disposal of the petition are as under:

3.1. Matrimonial relationship between the parties is strained. A petition under Section 12 (i)(c) of the Hindu Marriage Act came to be filed by the petitioner which is numbered as M.C.No.3882/2024. Relief in the petition is to declare that the marriage is a nullity on account of the fact that one of the spouses was a minor at the time of marriage.
3.2. However, cause title does not fortify the said contention.
3.3. Petitioner's wife is seeking transfer of the said petition to Mandya on the ground that the petitioner is not having sufficient means to attend the Court at Bengaluru and only with an intention to harass the petitioner; a false petition came to be filed in the Court at Bengaluru.
4. Respondent did not appear before the Court.
5. In the light of the arguments put forth on behalf of the petitioner, this court perused the material on record meticulously.

6. On such perusal of the material on record, geographical distance and inconvenience to the party including the financial implications are no longer valid parameters for transfer of a case from one Court to another Court in view of the video conferencing facility.
7. Petitioner can effectively appear in the pending matrimonial case through video conferencing.
8. In that regard, if the petitioner files an application before the Court at Bengaluru; same shall be allowed by the learned Trial Judge and permit the petitioner to appear through video conference.
9. With the above direction, following:
