The present writ petition has been filled for following reliefs:- 10.1 This Hon'ble Court may kindly be pleased to call for the entire record concerning the issuance of the impugned orders by respondent No. 2 for its kind perusal and consideration. 10.2 This Hon'ble Court may kindly be pleased to issue an appropriate writ quashing the foreclosure of the admission process to the various technical courses vide the counseling notices issued by respondent No. 2 (ANNEXURE P-1). 10.3 This Hon'ble Court may kindly be pleased to issue an appropriate writ extending the time schedule for counseling for admission to the various technical courses till 15th September, 2025. 10.4 Any other relief, which this Hon'ble Court, may deem fit and proper, in the facts and circumstances of the case. 2.
Learned counsel for the petitioner submits that the petitioner is a
3 society duly registered under the provisions of the Chhattisgarh Society Registrikaran Adhiniyam 1973 and is running an institution of academic excellence in the name of RSR Rungta College of Engineering & Technology wherein it has multiple technical courses (9 under graduate courses and 7 post graduate courses) being run in its college upon having the due affiliation, permission and sanction from the competent authorities. He further submits that the petitioner being an institution in the State of Chhattisgarh is governed by the schedule prescribed by respondent No. 2 with respect to the Counseling process for the purpose of admission to it various courses. He further submits that technical courses are being governed by the All India Council for Technical Education (AICTE) having been constituted by the All India Council for Technical Education Act 1987 which was enacted to provide for establishment of said Council with a view to have proper planning and coordinative development of the technical education. He further submits that AICTE has prescribed the Academic Calendar 2025-26 providing for the schedule for admission for students to the various seats of technical courses and according to the said academic calendar, the admission to various technical courses is permitted till 15th September 2025 and the commencement of classes for 1st year students of technical courses shall begin from 15th September 2025. Thus, the technical institutions engaged and imparting degree in technical courses throughout the country can admit students to the various technical courses till 15th
4 September 2025. However, unfortunately respondent No. 2 has issued the counseling schedule for admission to the various technical courses in the state and the last date for admission to the said courses has been prescribed as 14th August 2025 and not beyond that.
He further contends that the Respondent No. 2 has therefore acted in an absolutely highhanded and arbitrary manner in foreclosing the process of counseling for admission to the various technical courses and because of the said decision the petitioner institution have been left vacant several seats more than 475 seats in different Branches of the technical courses and therefore he prays for quashing of the foreclosure of admission process and extending the time schedule for counseling for admission to the various technical courses. 3. On the other hand, learned Advocate General appearing for the State opposes the submissions made by the learned counsel for the petitioner and submits that proper counselling was carried out in three rounds that too in a transparent and structured manner, ensuring that all eligible candidates received accurate information regarding courses, eligibility criteria, fee structure, and career opportunities. He further submits that the petitioner institute has already been affiliated with the Chhattisgarh Swami Vivekanand Technical University, Bhilai, as is evident from Annexure – P/3 and it has already participated in the counselling process and now they are claiming the academic schedule fixed by the AICTE despite the fact that the same is applicable to the newly affiliated
5 institutes only. 4. We have heard learned counsel for the parties, perused the impugned order and other documents appended with writ petition. 5. Bare perusal of the documents shows that the petitioner institute has already been affiliated with the Chhattisgarh Swami Vivekanand Technical University, Bhilai, as is evident from Annexure – P/3 and it has already participated in the counselling process and now they are claiming the academic schedule fixed by the AICTE despite the fact that the same is applicable only to the newly affiliated institutes.
Since the petitioner has already took part in the counselling in three rounds, it cannot be allowed to continue the same as per the schedule given by the AICTE to the newly affiliated institutes only on the ground that several seats of technical courses in different branches are lying vacant. The petitioner by taking the plea of schedule given by the AICTE cannot seek any direction for extension of time schedule for counselling for admission to the various technical courses. 6.
