1. Learned advocate representing the State respondents submits that the allotment of flat no. B/6 to the petitioner has been cancelled on the request made by the petitioner that he will not be able to walk up to the said flat which is in the second floor.
2. Flat no. X/3 in the 1st floor has been allotted to the petitioner after cancellation of flat no. B/6 in the second floor keeping in mind the health issue as reported by the petitioner.
3. Learned advocate for the petitioner submits that the petitioner is already occupying the flat no. B/6 and he is not interested to shift to flat no. X/3.

4. It has been brought to the notice of the Court by the learned advocate representing the State respondents that flat no. B/6 is yet to be allotted to any other person.
5. As the petitioner is already occupying the flat no. B/6 and is interested to reside at the same flat, that is, B/6, the allotment made in favour of the petitioner in respect of flat no. X/3 shall be treated as cancelled.
6. It will be open for the respondent authority to put up flat no. X/3 for allotment in favour of any other interested applicant.
7. The authority shall take steps to regularize flat no. B/6 in favour of the petitioner at the earliest in the event there is no impediment in law to do so. If flat no. B/6 cannot be regularized in favour of the petitioner as per his entitlement, the same shall be made known to him.
8. The writ petition stands disposed of.
9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
